Did you know that
		Llano News reported on

Motion to Recuse Judge Stubbs - without context?
Last week, Llano News reported on the petition for
Writ of Mandamus to void a vote  on the
secret & illegal attempt to rewrite the
city's Comprehensive Plan. The article is below and the response
		was:
		Letter to the Editor
Last week’s article in the Llano News, “Stubbs Denies
Petition in Sewell vs. City of Llano”, omitted essential context:
		1.  My legal action is about the City’s secret
attempt to “overhaul the Comprehensive Plan” to support their
ill-advised overhaul of the zoning ordinance. The city violated the Open
Meetings Act in an attempt to hide this overhaul from citizens and
		preclude citizen input. See complaint
		here:
		2. These “overhauls” will affect every citizen’s use
		of their property.
		3.  Neither the meeting notice nor any supporting
City documents mentioned the overhaul, yet during the vote, when
citizens are not allowed to speak, Mayor Virdell and Brenton Lewis
described it as “the Comprehensive Plan Grant” and the purpose was to
		“overhaul the Comprehensive Plan.”
		4.  City Attorney Bovey’s lies to which I referred
are from his written statements and documented in a
		Motion for
		Sanctions.
		5.  One of many of Judge Stubbs’ biased
		statements:
COURT:  Well, you understand why they don't want to
set a precedent of any time someone complains and they file a writ
having to go back and undo and redo stuff, though? I mean, you
		understand that, don't you?
MR. SEWELL:  No, not at all. If the City makes a
mistake they should be forthcoming and fix the mistake as quickly as
		possible.
		6. Judge Stubbs’ statement shows contempt for, and
bias against, a citizen trying to correct a City error.
		7.  Judge Stubbs manufactured a reason, not
based in law, to deny the temporary writ. This is abuse of discretion.
		8.  A
		Motion to
		Recuse Judge Stubbs was filed..
The City has had numerous opportunities to resolve
this, without any costs to the citizens.  Judge Stubbs’ statement and
the City’s spending $20,000 in legal fees shows that the issue for the
City is “precedent” and ramming through a Comprehensive Plan at any
cost, rather than respect for property rights and citizens.
